The lawsuit centers on allegations that an 11-year-old girl was sexually assaulted in the pool area of the Radisson Hotel Miami Beach by a man police identified as Osvaldo Diaz.

According to the complaint, the girl’s family says the hotel failed to provide adequate security and allowed Diaz — who police say was not a registered guest — to access the private pool area. The family is seeking more than $15 million in damages.

Police records cited in reports say Diaz, 69, was arrested on Oct. 27, 2025, and charged with:

  • Lewd and lascivious battery on a child
  • Burglary with assault or battery

The child’s family, who were visiting from Sweden, alleged that Diaz grabbed the girl inappropriately while she was swimming. After she reported the incident to her family, her father confronted Diaz before hotel security and police intervened.

Investigators said a hotel manager later confirmed that Diaz was not authorized to be in the pool area. Authorities also alleged that Diaz attempted to leave when police arrived, though hotel security kept him in sight until officers detained him.

The family’s attorney argued that visible security was lacking at the property and that better safety measures could have prevented the incident.

As of the latest reports, Diaz remained in custody with bail set at $15,000. The criminal case against him is still pending, and the civil lawsuit against the hotel had just been filed.
